Intersections with Other Laws

Creating safe and inclusive workplaces requires not just a strong legal framework but its barrier-free and empathetic implementation which requires the Sexual Harassment of Women at Workplace (Prevention, Prohibition & Redressal) Act 2013, (POSH Act) to interact with various other social welfare legislations curated on the principles of the Indian Constitution.

For instance, the interactions between the POSH Act and the Rights of Persons with Disabilities Act, 2016 and the Transgender Persons (Protection of Rights) Act, 2019 aim to ensure that persons with disabilities, and persons recognising themselves to be part of the LGBTQIA+ community are protected from harassment and are able to access complaint mechanism in a barrier free and inclusive manner.

This series aims to spotlight the intersections and the complexity of addressing sexual harassment as a social evil and the need for a comprehensive approach to ensure the effective enforcement of the POSH Act.
